Conditions d’utilisation
These terms of sale apply to every purchase made on anno.wine and in the ANNO app. Please read them before you buy: the nature of what we sell, bottles that are many decades old, makes them particularly important. By placing an order you confirm that you have read and accepted them, in particular sections 2, 4 and 9.
1. Who we are
ANNO is a brand of Sottocolle S.r.l.s., Via Giacomo Puccini 1940/V, 55016 Porcari (LU), Italy. VAT and tax code: IT02578070464. E-mail: info@anno.wine. Telephone: +39 342 639 8349, Monday to Friday, 9:00 to 18:00 CET.
2. What we sell: collectible bottles, sold as seen
ANNO sells old vintages of wine and spirits as collectible items. What you buy is a specific bottle, for its value as a vintage, as a rarity and as the gift of a year that counts; it is not sold as a product for everyday consumption. As in a wine auction, each bottle is sold as seen: in the condition described in its listing.
3. Descriptions, condition and photographs
Each listing states the producer, the wine, the vintage, the format and the external condition of the bottle: fill level, label, capsule and, where visible, the cork, using the terms explained on Bottle condition. Photographs are either photographs of the bottle itself or illustrative images; illustrative images are marked as such on the listing.
Before you buy, you can ask us for real photographs and a condition report of the bottle, and a person will answer. We encourage you to do so if you have any doubt. Once the order is placed, the condition declared in the listing is deemed accepted.
4. No guarantee of drinkability
We give no guarantee, in any form, of the drinkability or of the taste of the wine or spirit inside a bottle. A bottle that is 30, 40, 50 years old or more may show oxidation, cork taint, a low fill level or other changes to its contents that cannot be seen from the outside and that no one can foresee. Our checks concern the outside of the sealed bottle and its apparent storage; they are not, and cannot be, a guarantee about the contents. Anyone who buys an old vintage accepts this risk knowingly.
5. Prices and payment
Prices are shown in euro. For deliveries within the European Union they include VAT. Shipping costs depend on the destination and on the weight of the parcel and are shown at checkout before you pay. For deliveries outside the European Union, import duties and taxes of the destination country are not included (see our Shipping policy).
You pay at checkout, with the payment methods shown there.
6. Orders and availability
Your order is an offer to buy. The contract is concluded when we send you the order confirmation by e-mail. Every bottle is a unique item: if a bottle you ordered turns out to be no longer available, or does not pass our final check before dispatch, we cancel that item, refund it in full straight away and, if you wish, suggest alternatives from the same year, without any obligation.
We may refuse or cancel an order in the case of an obvious error in the price or in the listing, of suspected fraud, of a buyer under the legal age, or of a destination to which alcohol cannot be delivered; any amount paid is refunded in full.
7. Delivery
We deliver to the countries offered at checkout, in seven to ten working days, by tracked courier, against the signature of an adult. Times, destinations, duties and what to check on delivery are set out in our Shipping policy.
8. Damage in transit and Transit cover
At checkout you can add Transit cover, an optional service costing about 5% of the order value, shown in the cart before you pay and never pre-selected. With Transit cover, a bottle that arrives broken or a parcel that is lost is replaced with a bottle from the same year where one can be found, or refunded in full including delivery, within 48 hours of your photographs reaching us. Without Transit cover, we handle the claim with the courier on your behalf, and replacement or refund follow the courier's procedure and liability limits.
In every case, report the damage to us within 48 hours of delivery, with photographs of the outer box, the packing and the bottle, and keep all the packaging until the claim is closed.
9. No right of withdrawal and no returns
9.1 The right of withdrawal does not apply to the bottles sold by ANNO, and returns and exchanges are not accepted, for two reasons that come from the nature of the goods:
- They are collectible items sold as seen. As in a wine auction, what you buy is a specific old bottle in the condition described, whose value depends on its provenance and on an unbroken history of proper storage.
- They are goods liable to deteriorate. A bottle that is decades old is fragile: a few hours of heat or cold, exposure to light, vibration or being kept in the wrong position can alter its contents irreversibly, with no visible sign on the outside. Once a bottle has left our hands we can no longer know or guarantee how it has been kept, and a bottle sent back could no longer be offered as a collectible item with a guaranteed provenance.
9.2 Accordingly, under Article 59(1)(d) of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005), which excludes the right of withdrawal for goods liable to deteriorate, and under Article 59(1)(e) for any bottle whose capsule, cork or seal has been removed after delivery, no withdrawal, return or exchange is accepted, including on grounds of taste, drinkability, the natural evolution of the wine, the choice of vintage or a change of mind.
9.3 This does not affect the cases in which we always step in: a bottle that is no longer available (section 6), damage in transit (section 8) and a bottle that does not match its listing (section 10).
10. A bottle that does not match its listing
We guarantee that every bottle is authentic and matches its listing: producer, wine, vintage, format and the external condition declared. If the bottle you receive does not match, tell us within 48 hours of delivery with photographs: we collect it at our expense and send you a bottle that matches the listing where one can be found, or refund you in full, including delivery. The characteristics that come with age, when consistent with the listing (fill level, sediment, marks of time on the label, capsule and cork), and the taste of the contents are not a mismatch.
11. Sale to adults only
The sale of alcoholic drinks is restricted to adults. By placing an order you declare that you are at least 18 years old and of legal age to buy alcohol in the country of delivery (for example 21 in the United States and 20 in Japan). We may ask for proof of age, and deliveries are made to an adult.
12. Liability
Our liability for an order is limited to the price paid for it, except in cases of wilful misconduct or gross negligence and wherever the law does not allow such a limit. We are not responsible for how a bottle is kept, opened or served after delivery, nor for delays caused by customs checks, strikes, extreme weather or other events beyond our control.
13. Personal data
We process your personal data as described in our Privacy policy.
14. Governing law, complaints and disputes
These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence, and the courts of your place of residence have jurisdiction. For all other buyers, the court of the place where Sottocolle S.r.l.s. has its registered office has jurisdiction.
For any complaint, write to info@anno.wine or call +39 342 639 8349: we reply within one working day.
Nothing in these terms excludes or limits rights which, under the mandatory law applicable to you as a consumer, cannot be excluded or limited.
